Rural Communities and the Colombian Pension System: Perspectives and Challenges Under Law 2381 of 2024

Abstract

This article analyzes the inclusion of rural communities in the comprehensive social protection system for old age, disability and death, established in Law 2381 of 2024. First, rural communities are characterized based on data from the National Quality of Life Survey, highlighting structural problems such as high labor informality, seasonal income and limited access to basic services. A critical analysis of the pillars of the pension system (solidarity, semi-contributory, contributory and voluntary savings) is also carried out and, finally, the specific provisions aimed at the inclusion of rural communities in the pension system are identified. Qualitative research with a hermeneutic approach uses tools such as normative analysis, bibliographic review and systematization of statistical data to contextualize the legal provisions in relation to the realities of the Colombian countryside. It is concluded that, although Law 2381 of 2024 represents a step towards equity in access to social security, its effectiveness depends on overcoming key challenges in its implementation. It is essential to strengthen the resources allocated to the solidarity and semi-contributory pillars, make the requirements of the contributory pillar more flexible and simpler, and develop strategies adapted to the conditions of the Colombian countryside, such as financial literacy programs, technological connectivity and operational support for rural communities. Without these changes, the pension system could perpetuate the historical inequalities affecting these populations, preventing the achievement of true universality and progressiveness enshrined in the Constitution. Only through a comprehensive approach and efficient implementation will it be possible to guarantee effective and dignified social protection for rural communities in terms of pensions.
